Terms of Service

These Terms of Service ("Terms") govern your use of easycircuit.app, the EasyCircuit editor and Copilot, our store, and related services (the "Services"), provided by EasyCircuit ("EasyCircuit", "we", "us"). By creating an account or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be at least 13 years old to use the Services. If you are under 18, you may use them only with a parent or guardian's permission, and they agree to these Terms on your behalf. You are responsible for your account, for keeping your login secure, and for everything that happens under it. Give us accurate information and tell us promptly about any unauthorized use.

2. Your content

"Your Content" means the prompts, messages, designs, schematics, firmware, files, photos, and other material you submit to the Services, together with the designs and outputs the Services generate for you. As between you and us, you own Your Content.

License to us. You grant EasyCircuit a worldwide, non-exclusive, royalty-free, transferable license, with the right to sublicense to our service providers, to host, store, copy, process, analyze, adapt, and display Your Content in order to:

• operate, provide, secure, and support the Services;
• improve the Services, including through testing, research, and developing, evaluating, and training the models, tools, and features that power EasyCircuit; and
• create de-identified or aggregated data from Your Content, which we may use and share as described in our Privacy Policy.

This license continues for as long as Your Content is stored in the Services and for a reasonable period afterward to complete deletion from backups. Our rights in de-identified or aggregated data, and in models and features already developed, continue after you delete Your Content or your account. The license transfers with the Services to any successor in a merger, acquisition, or sale of assets.

You confirm that you have the rights needed to submit Your Content and to grant this license, and that Your Content does not violate the law or anyone else's rights.

Feedback. If you send us ideas or suggestions, we may use them without restriction or compensation.

3. AI-generated designs

The Copilot uses AI to suggest circuits, wiring, parts, firmware, and instructions. These outputs can be incomplete or wrong, and similar requests may produce different results. Outputs are not professional engineering advice, are not certified for safety, and have not been reviewed by a licensed engineer. You are responsible for checking every design, part rating, and connection before you build, power, or flash anything. Do not use the Services for mains voltage, high-current or high-energy systems, medical, automotive, or other safety-critical uses without qualified professional review.

4. Acceptable use

You agree not to:

• break the law or infringe anyone's rights;
• use the Services to design weapons or devices intended to cause harm;
• access the Services in ways that bypass limits or security, or interfere with their operation;
• scrape, copy, or bulk-download the Services, the parts catalog, or other users' content by automated means;
• use the Services or their outputs to build a competing product or train a competing model; or
• resell or provide the Services to others without our written permission.

5. Store purchases

Purchases from our store are also governed by the prices, shipping terms, and return policy shown at checkout. Some items are made to order. Prices and availability may change. We may cancel an order and refund you if an item is unavailable or a price was listed in error.

6. Our property

The Services, including the software, parts catalog, graders, branding, and site content, belong to EasyCircuit and its licensors. These Terms give you a limited, personal, non-exclusive, non-transferable right to use the Services as offered. All other rights are reserved. Open source components are governed by their own licenses.

7. Third-party services

The Services rely on third-party providers, including AI model providers and payment processors, and may link to third-party sites and products. We are not responsible for third-party services, and your use of them may be subject to their terms.

8. Suspension and termination

You may stop using the Services and ask us to delete your account at any time. We may suspend or end your access if you violate these Terms, if required by law, or if we discontinue the Services. Sections 2 (license survival and feedback), 3, and 6 through 14 survive termination.

9. Disclaimers

THE SERVICES AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT ANY DESIGN WILL WORK OR BE SAFE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EASYCIRCUIT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, OR FOR DAMAGE TO PROPERTY OR EQUIPMENT RESULTING FROM BUILDING OR USING A DESIGN. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $50. Some jurisdictions do not allow these limits, so they may not apply to you.

11. Indemnity

You will defend and indemnify EasyCircuit against claims, losses, and costs arising from Your Content, your use of the Services or of any design, or your violation of these Terms or the law.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in California, and you and we consent to their jurisdiction. Nothing here limits rights you have under consumer protection laws that cannot be waived.

13. Assignment

You may not transfer these Terms without our consent. We may assign or transfer these Terms, and the rights and licenses granted to us, including in connection with a merger, acquisition, reorganization, or sale of assets.

14. Changes and general terms

We may update these Terms. We will post the new version here with a new effective date and, for material changes, give notice through the Services or by email. Continuing to use the Services after a change takes effect means you accept it. These Terms and our Privacy Policy are the entire agreement between you and us about the Services. If any part is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver.
